Decision of the Press Council

At its meeting on 10 December 2010 the Press Council considered the application of Luke Gardiner Ltd to appeal the decision of the Press Ombudsman. The application to appeal was admitted for full hearing by the Press Council as the appellant had made out an arguable case that there may have been procedural flaws in the Press Ombudsman’s handling of it’s complaint.

The Press Council found that there were no errors in the procedures adopted when considering the complaint nor in the application of the Principles of the Code of Practice for Newspapers and Magazines.

The Press Council agreed with the findings of the Press Ombudsman that The Irish Times had made an offer of sufficient remedial action to resolve the complaint.

The decision of the Press Ombudsman was upheld.
