Decided by the Press Ombudsman

If a resolution to the complaint cannot be achieved through conciliation, the Press Ombudsman will consider the complaint and make a decision.

If the Press Ombudsman finds a breach of the Code of Practice, the complaint will be upheld, and the publication will have to publish that part of the decision upholding the complaint.

The Press Ombudsman has decided to uphold a complaint by Ms Maeve Clarke that an article in the Irish Independent on 17 September 2011 about the findings of an OECD Report on teachers’ pay and conditions breached Principle 1 (Truth and Accuracy) of the Code of Practice for Newspapers and Magazines because it stated inaccurately that the number of hours worked by Irish secondary teachers was “significantly lower” than the OECD average.

Watkins and the Irish Sun

05 December 2011

The Press Ombudsman has decided that there was insufficient evidence for him to make a decision that a statement in an article published in the Irish Sun on 22 August 2011 breached Principle 1 (Truth and Accuracy) of the Code of Practice for Newspapers and Magazines. He decided that an offer made by the newspaper represented an offer of sufficient remedial action to resolve another part of the complaint under the same Principle. A further complaint under Principle 4 (Respect for Rights) was not upheld.

Sullivan and the Sunday Independent

13 September 2011

The Press Ombudsman has decided to uphold a complaint by Ms Jerrie Ann Sullivan that an article in the Sunday Independent on 19 June 2011 about events at Shell to Sea protests in County Mayo was a breach of Principle 1 (Truth and Accuracy) of the Code of Practice for Newspapers and Magazines because it associated a protest in which she was involved with events that took place on another, later, occasion in a manner that could reasonably be considered as significantly misleading. He also decided that as there was no verifiable evidence to corroborate a statement reported as fact in the headline, the article was in this respect also in breach of Principle 2 (Distinguishing Fact and Comment) of the Code.

Dunne and the Enniscorthy Guardian
